BURKINA FASO’s Legislative Assembly of the People (ALP) has unanimously approved the ratification of the 2014 Montréal Protocol on offences and certain other acts committed on board aircraft, strengthening the country’s legal framework for aviation security and in-flight incidents. Adopted under the auspices of the International Civil Aviation Organization (ICAO) in 2014 and entering into force internationally in 2020, the Montréal Protocol updates the 1963 Tokyo Convention by expanding criminal jurisdiction beyond the state in which an aircraft is registered. Under the updated framework, both the State of landing and the State of the aircraft operator can exercise jurisdiction over serious offences committed on board, helping close legal gaps that previously complicated the prosecution of unruly or violent passengers and other acts that threaten aircraft and passenger safety.
